Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Orbyte platform, website, and related services (“Services”) operated by Orbyte (“we,” “us,” or “our”). By creating an account or using our Services, you agree to be bound by these Terms.
Your Account
Section titled “Your Account”You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@orbyte.app if you suspect unauthorized access.
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent’s or guardian’s permission to use the Services.
Your Content
Section titled “Your Content”You retain all ownership rights to the photos, videos, and other files you upload to Orbyte (“Your Content”). By uploading content, you grant us a limited license to store, process, and display Your Content solely to provide the Services to you - including AI analysis, face detection, duplicate detection, and search indexing.
We do not claim ownership of Your Content. We do not use Your Content to train machine learning models. We do not share Your Content with third parties except as described in our Privacy Policy.
You are responsible for ensuring you have the right to upload any content you submit. You agree not to upload content that is illegal, infringes on others’ rights, or violates these Terms.
Groups and Shared Content
Section titled “Groups and Shared Content”If you create or join a Group, any content you upload to that Group becomes visible to all members of that Group. You are responsible for ensuring you are comfortable sharing content before uploading it to a Group.
As a Group owner, you are responsible for managing membership and the content shared within your Group. You may remove members or content at any time.
Acceptable Use
Section titled “Acceptable Use”You agree not to:
- Use the Services for any unlawful purpose
- Upload content that infringes on intellectual property rights, contains malware, or is otherwise harmful
- Attempt to gain unauthorized access to our systems or other users’ accounts
- Interfere with or disrupt the Services or servers
- Use automated tools to scrape, crawl, or extract data from the Services without our permission
- Resell or redistribute the Services without our consent
- Harass, abuse, or harm other users
We reserve the right to suspend or terminate accounts that violate these Terms.
Subscriptions and Payment
Section titled “Subscriptions and Payment”Orbyte offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) through our payment processor. You authorize us to charge your payment method for the subscription fees.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period - you retain access to paid features until then. We do not provide refunds for partial billing periods.
We may change our pricing with reasonable notice. Price changes take effect at the start of your next billing period after the change is announced.
Storage Limits
Section titled “Storage Limits”Each plan includes a storage allocation. If you exceed your plan’s storage limit, you may not be able to upload additional content until you free up space or upgrade your plan. We will not delete your existing content if you exceed your limit.
Service Availability
Section titled “Service Availability”We strive to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
Intellectual Property
Section titled “Intellectual Property”The Orbyte name, logo, and all associated branding, software, and documentation are the property of Orbyte and are protected by intellectual property laws. These Terms do not grant you any rights to use our branding or intellectual property beyond what is necessary to use the Services.
Termination
Section titled “Termination”You may delete your account at any time through your account settings. Upon deletion, Your Content will be permanently removed from our servers within 30 days.
We may suspend or terminate your account if you violate these Terms, if your account is used for abusive or illegal activity, or if we are required to do so by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary.
Disclaimers
Section titled “Disclaimers”The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Services will meet your specific requirements, that AI-powered features will be perfectly accurate, or that the Services will be uninterrupted.
Limitation of Liability
Section titled “Limitation of Liability”To the maximum extent permitted by law, Orbyte shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
Changes to These Terms
Section titled “Changes to These Terms”We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by email. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Governing Law
Section titled “Governing Law”These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
